Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BuyThisCarOnline.com, seller kits, vehicle listings, messages, forms, and related services (collectively, the “Service”). By using the Service or purchasing a kit, you agree to these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

You must be at least 18 years old and legally able to enter into a binding agreement. If you use the Service for a business or another person, you represent that you have authority to bind that party.

2. What the Service Provides

The Service provides advertising materials and online tools intended to help owners advertise and sell vehicles privately. Features may include a removable rear-bumper sticker, side-window For Sale signs, a unique QR code and activation number, a vehicle listing, search, private contact tools, Test Drive Assurance information, a buyer–seller agreement, and links or connections to independent service providers.

Buy This Car Online is not the buyer or seller of listed vehicles and is not a motor-vehicle dealer, lender, insurer, warranty company, vehicle-history provider, escrow company, title company, law firm, or government agency. We do not guarantee that a vehicle will sell, that a buyer or seller is legitimate, that information is accurate, or that any transaction or meeting will be safe.

3. Accounts, Passwords, and Activation Codes

• Provide accurate account information and keep it current.
• Protect your password and promptly notify us of suspected unauthorized access.
• Each physical kit’s activation number and QR code are intended for the vehicle listing activated with that code. Do not copy, resell, guess, misuse, or attempt to reactivate a code without permission.
• You are responsible for activity conducted through your account and for obtaining permission before submitting information about another person.

4. Seller Responsibilities

If you create a vehicle listing, you represent that you own the vehicle or are legally authorized to advertise and sell it. You agree to:

• Provide truthful, current information about ownership, title status, VIN, mileage, condition, damage, price, photos, location, and other material facts.
• Disclose information required by applicable law and avoid misleading statements or altered photos.
• Use only photos and content you have the right to use.
• Confirm the buyer’s identity, funds, payment method, and all required state forms.
• Comply with title, registration, odometer, emissions, tax, notice-of-sale, license-plate, and other legal requirements.
• Remove or update the listing and physical signs when the vehicle is no longer available.

5. Buyer Responsibilities

Buyers must independently inspect the vehicle, verify ownership and title, check the VIN and history, confirm mileage and condition, evaluate recalls or liens, arrange financing, and complete required documents. A listing is advertising supplied by its seller, not a warranty or inspection by Buy This Car Online.

6. Meetings, Test Drives, and Safety

You are solely responsible for deciding whether, when, where, and how to meet another person or permit a test drive. Consider meeting in daylight at a monitored public location, bringing another adult, telling a trusted person where you are, and following local law. Before a test drive, participants should independently verify identity, driver status, and applicable insurance coverage.

The Test Drive Assurance form is a planning and documentation aid only. It does not conduct a background check, verify information, create insurance coverage, determine which policy applies, prevent crime or accidents, or guarantee anyone’s safety. Any proposed route, geographic area, or speed limit is an agreement between the participants and is not technical vehicle tracking or geofencing by the Service unless expressly stated for a particular feature.

7. Buyer–Seller Agreements and Government Forms

Any buyer–seller agreement or bill-of-sale aid provided through the Service is a general informational form and is not legal advice or a substitute for state-required documents. Requirements vary by state and transaction. Buyer and seller are responsible for obtaining and completing the correct DMV, title, tax, odometer, emissions, lien-release, and related forms.

8. Messages and Acceptable Use

Do not use the Service to harass, threaten, discriminate, defraud, spam, impersonate another person, collect information without permission, distribute malware, interfere with the Service, or advertise stolen, unsafe, prohibited, or unlawfully offered vehicles or goods. Do not place sensitive personal information in public listings. We may review reported activity and may remove content or suspend access when reasonably necessary to operate or protect the Service.

9. Third-Party Services, Dealer Bids, and Affiliate Links

Financing, warranties, vehicle-history reports, dealer bids, inspections, title services, DMV resources, escrow, shipping, payment processing, and other third-party products are provided by independent organizations under their own terms and privacy policies. Availability varies. We do not guarantee approval, pricing, coverage, accuracy, performance, or a minimum number or amount of dealer bids.

Some links or referrals may be affiliate relationships, and we may receive compensation if you purchase or complete an action. A paid relationship does not change your responsibility to evaluate the provider, and we will make disclosures where required.

10. Orders, Pricing, Payment, and Shipping

Prices, availability, taxes, shipping charges, delivery estimates, and product details are shown during the ordering process and may change before purchase. You authorize the applicable payment provider to charge the amount shown at checkout. Delivery estimates are not guarantees. You are responsible for providing a complete and accurate shipping address.

11. Returns, Refunds, and Replacement Items

Unless a different policy is displayed at checkout, you may request a return within 30 days after delivery if the physical kit is unused, unaltered, and in its original condition and the activation code has not been activated. Contact us before returning anything so we can provide instructions. Original shipping charges and return shipping are generally nonrefundable unless we shipped the wrong item or the product arrived defective.

Activated codes, used stickers or signs, completed digital services, and downloadable or personalized materials are not returnable except where required by law. If a kit arrives damaged, incomplete, or with a code that does not work, contact us promptly and provide reasonable documentation so we can evaluate a replacement or other appropriate remedy. Refund timing may depend on the payment provider. This section does not limit rights that cannot legally be waived.

12. User Content

You retain ownership of content you submit. You grant Buy This Car Online a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, distribute, and otherwise use that content as reasonably necessary to provide, promote, secure, and improve the Service. You may end this license for future use by deleting content where the Service allows, subject to reasonable backup, legal, safety, and record-retention needs.

13. Intellectual Property

The Service, brand names, logos, designs, software, and original content are owned by or licensed to Buy This Car Online and are protected by applicable law. Except for ordinary personal use of a purchased kit and the Service, you may not copy, modify, distribute, sell, reverse engineer, or create derivative products from them without written permission.

14. Service Changes and Account Suspension

We may change, add, suspend, or discontinue features; perform maintenance; correct errors; or limit access for security, legal, operational, or misuse reasons. We may suspend or terminate accounts or listings that violate these Terms or create risk. Where practical, we will provide notice, but urgent action may be taken without advance notice.

15. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted operation, error-free content, successful sales, buyer or seller conduct, vehicle quality, insurance coverage, or third-party services. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

16. Limitation of Liability

To the extent permitted by law, Buy This Car Online and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal dealings between users, vehicle defects, payment fraud, accidents, injuries, theft, or third-party services arising from or related to the Service. Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the applicable kit or Service during the 12 months before the claim or $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Buy This Car Online and its owners, employees, contractors, and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your listing, content, vehicle, sale or purchase, meeting or test drive, violation of these Terms, violation of law, or infringement of another person’s rights.

18. Governing Law and Disputes

These Terms are governed by applicable United States law and the laws of the state in which the operator of Buy This Car Online is established, without regard to conflict-of-law rules, except where consumer law requires otherwise. Before filing a formal claim, please contact us and allow a reasonable opportunity to try to resolve the issue informally. Nothing in these Terms prevents either party from using an eligible small-claims process or exercising rights that cannot be waived.

19. Changes to These Terms

We may update these Terms as the Service changes. Revised Terms will be posted with a new “Last updated” date. Changes apply prospectively unless law requires otherwise. Continuing to use the Service after revised Terms take effect means you accept them.
